1. About Elthara
These Terms & Conditions govern your use of elthara.space, Your Elthara account, and purchases of Elthara digital works. Elthara is operated from Alberta, Canada. Questions about these terms, an account, or an order may be sent to hello.c.anne@gmail.com.
2. Entering and using Elthara
You may enter and read the publicly available parts of Elthara without making a purchase. If you create an account or purchase a work, you agree to provide accurate information and to keep your account credentials private. You are responsible for activity carried out through your account unless you notify Elthara that the account may have been compromised.
You must have the legal capacity to enter into a purchase, or have the authorization of a parent or legal guardian where required.
3. Digital works and personal licence
Elthara works, including The Journey and Fragments of Elthara, are copyrighted works. A purchase gives you a personal, non-exclusive, non-transferable licence to access and use the purchased digital work for your own personal use. Ownership of the copyright and other intellectual property does not transfer to you.
You may download a purchased PDF for your own devices and personal backup. You may not resell, redistribute, publicly post, upload, reproduce for commercial use, remove ownership notices from, or make the work available to others as a substitute for their own purchase, except to the extent a right cannot lawfully be restricted.
4. Prices and payment
Prices are shown in Canadian dollars (CAD) unless clearly stated otherwise. The total price shown at checkout is the amount you authorize for the selected work. Payments are processed securely by Stripe. Elthara does not receive or store your full payment-card number.
A purchase is complete only after payment has been successfully confirmed. A failed, cancelled, abandoned, or unconfirmed payment does not create ownership of a work.
5. Digital delivery
Purchased works are delivered digitally to Your Elthara after payment is confirmed. Your account provides continuing access to the works attached to it and, where offered, a PDF download. There is no physical shipment.
If a confirmed purchase does not appear in Your Elthara, or a download or account does not work as expected, contact hello.c.anne@gmail.com and include the email address used for the purchase and your Elthara order number if available.
6. Refunds and cancellations
Because Elthara works are digital products made available after purchase, all sales are final. Elthara does not offer voluntary refunds, returns, exchanges, or cancellations once a purchase has been completed, except where required by applicable law. The Refund & Cancellation Policy forms part of these terms.
7. Your statutory rights
Nothing in these terms excludes, restricts, or waives a consumer right or remedy that cannot lawfully be excluded, restricted, or waived. If applicable consumer-protection law gives you a right that conflicts with these terms, that legal right continues to apply.
8. Availability and changes
Elthara may maintain, update, improve, or temporarily interrupt the site, account area, readers, downloads, or other features. Reasonable efforts will be made to preserve legitimate purchased access. Elthara may also correct errors in descriptions, pricing, or site content before a purchase is completed.
9. Appropriate use
You may not attempt to gain unauthorized access to Elthara systems or accounts, interfere with site security, use automated methods to abuse the service, or use Elthara in a way that violates applicable law or another person's rights.
10. Nature of the works
Elthara is a creative and reflective body of work. Its writings are offered for reading, reflection, and personal experience. They are not medical, mental-health, legal, financial, or other professional advice, and they are not a substitute for professional care or services when those are needed.
11. Privacy
Personal information is handled as described in the Privacy Policy. Account and order information is used to provide access, maintain purchase records, support readers, protect Elthara, and meet applicable legal obligations.
12. Responsibility and limits
Elthara will provide purchased digital access as described and will address genuine order or access problems. To the extent permitted by applicable law, Elthara is not responsible for losses caused by circumstances outside its reasonable control, incompatible or unsupported third-party devices or software, or a user's failure to protect their own account credentials. Nothing in this section limits liability or remedies that cannot lawfully be limited.
13. Changes to these terms
Published versions of these terms are kept as separate versions. A new version may apply to future use or future purchases after it becomes effective. The version presented for a purchase remains part of the record of the terms that applied at that time.
14. Governing law
These terms are governed by the laws of Alberta and the applicable laws of Canada, subject to any mandatory consumer-protection law that applies to you. Nothing in these terms prevents you from using a court, regulator, complaint process, or other remedy that the law makes available to you.
